For many Poles, the decision to take out a loan in Swiss francs seemed an attractive solution. Unfortunately, with the sharp rise in the value of the franc, many borrowers found themselves in a difficult situation, struggling with high instalments and mounting debt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">More and more people are choosing to take legal action and bring a case against the bank.&nbsp;<strong>Court hearing<\/strong>&nbsp;can be a complex process, requiring careful analysis of documents, preparation of relevant arguments and gathering of the necessary evidence. It is therefore important to prepare properly. When outsourcing a case to a lawyer, you do not have to worry about preparing the formal side of the case. The attorney will help to complete all the documents and will prepare and submit the claim to the court, as well as represent you before the court. However, the attorney cannot give evidence for the&nbsp;<strong>borrowers<\/strong>.<br>In this post, I will provide useful tips that can help you prepare to give evidence in court.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">WHAT IS THE COURT ASKING IN THE FRANKING CASE?<\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">At the hearing on&nbsp;<strong>franking credit<\/strong>, the court may ask various questions to better understand the case and make an appropriate determination.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">First, the court will ask about the circumstances under which the mortgage loan agreement was concluded. Did the plaintiffs use an intermediary prior to the agreement, how were the meetings with the bank's employees, for what purpose was the loan taken out, did the plaintiffs have a business and, if so, was the loan taken out in connection with that business. The court may also ask where the borrower was working at the time.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Questions may then be asked about&nbsp;<strong>terms and clauses of the credit agreement<\/strong>. The court may ask about details of the interest rate, the term of the loan, the type of loan, as well as other relevant provisions of the agreement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court will also ask whether you were aware of the&nbsp;<strong>the risks associated with the Swiss franc loan<\/strong>. The court may examine whether you have received sufficient information from the bank about the&nbsp;<strong>currency risks<\/strong>&nbsp;and the possibility of a change in the exchange rate of the Swiss franc and how this change would affect the instalments and the balance of the loan.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court may ask whether the bank has clearly explained the&nbsp;<strong>valorisation mechanism<\/strong>, i.e. why the Swiss franc provisions were included in the loan agreement. Has the bank explained how the Swiss franc is determined&nbsp;<strong>Swiss franc exchange rate<\/strong>&nbsp;for the purpose of the loan. The court usually also asks whether these provisions were negotiated with the bank and whether any provision of the agreement was individually agreed with the borrower.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is worth remembering that the court's questions will depend on the specific case and individual circumstances. Therefore, it is important to prepare properly for the hearing by reviewing the documentation related to the loan and recalling the circumstances of the agreement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Remember, however, that this article does not constitute legal advice.
