The Bank Guarantee Fund applied on 28 April 2023 for a bankruptcy of Getin Noble Bank S.A.
Persons holding franking credits in this bank should already be preparing for the bankruptcy of Getin.
Once the Court has declared bankruptcy, all creditors will have to report their claims to the bankruptcy trustee. The deadline for filing is 30 days from the date of the bankruptcy notice. This must be done electronically by National Debtors Register.
In order to calculate the amount of the claim, it is necessary to collect documentation on the amount of all payments to the bank. To this end, transfer receipts can be used or a request can be made to the bank for a corresponding certificate.
We recommend setting off the borrower's claim against the bank's claim for repayment of the loan principal. The set-off can also be made at the latest when the claim is reported.
The borrower's claims reported to the trustee will only be subject to satisfaction to the extent that the assets of the bankruptcy estate will allow. This is impossible to assess at the moment. All borrowers with franking credits in Getin Noble Bank should be aware of a potential bank failure and prepare for the possible consequences.
